Values of Serious Personal Injury Cases
Predicting the trial value or even the settlement value of your personal injury case with certain accuracy is a very difficult task. There are numerous factors that will greatly impact the value of an injury claim. One issue is whether or not the insurance company is certain that your personal injury lawyer is prepared and willing to take your case to trial.
Another issue is make a prediction of what the jurors will believe your claim is worth as serious injury cases in Tennessee are typically decided by juries. The jury decides how much money to award you for your injuries and not all juries award the same amount of money.
Jurors are human and will bring in their own personal biases that may either help your case or hurt it. This creates a level of unpredictability in determining what your case is worth.
During settlement negotiations, the accident lawyers and insurance companies will calculate and average of what they believe a jury would award for a particular case. If the two parties are able to agree on what that average of that number is, the case will typically settle out of court as long as the client agrees.

Case 1
Our firm represented a young man who was severely injured in an automobile accident caused by a construction company who negligently failed to place proper traffic signs at an intersection. As a result, our client's vehicle violently collided with another vehicle, and our client sustained traumatic and permanent brain injuries. We developed the case by retaining experts such as a life-care planner and a neurological psychologist to demonstrate the special needs of our client. The case was litigated and mediated with a settlement for over $2,200,000.00. Prior to settling the case, we were able to significantly reduce the client's medical bills, which resulted in more money for the case.
Case 2
Our firm represented an individual concerning a personal injury and workers' compensation claim. Our client was working for his employer as a billboard poster, when he fell approximately 3S feet from a billboard catwalk. He sustained serious injuries, including 2 broken arms, which required surgery. We were able to get his temporary total disability payments started and upon his release from the doctor, we settled his workers' compensation claim. We investigated his personal injury claim and hired an expert engineer who determined that the catwalk was not properly welded. We litigated this case and we were eventually able to mediate our client's third party claim for over $950,000.00.
Case 3
Our firm represented a lady who was seriously injured in an automobile accident, whereby she was a passenger in a vehicle that was rear-ended by an 18-wheeler. Our client sustained multiple fractures, internal injuries, and a permanent eye injury. There were other individuals who were hurt in this accident as well, and we were dealing with limited insurance policy limits. We utilized the services of an ophthalmologist and orthopaedic surgeon who evaluated our client for permanent disability. A lawsuit was filed, and the case was mediated, and a settlement was reached for $850,000.00.
Case 4
Our firm represented a gentleman in both an automobile accident case and a workers' compensation claim, all resulting from the same accident. While in the scope of his employment, our client was driving his vehicle when the Defendant negligently made a left turn in front of him, thereby causing the accident. Our client sustained injuries, including two (2) broken legs, a broken tail bone, chipped teeth, and some scarring. We were able to immediately obtain compensation for our client in the form of temporary total disability payments while he was off of work. This allowed our client to pay his bills. After our client was released, we settled his workers' compensation claim, with open medicals to be paid by his employer for life. Our office then litigated his automobile accident case, and our client received a settlement of $450,000.00 for medical bills, lost wages, and pain and suffering. By law, our client's employer was entitled to a credit for amounts paid by workers' compensation, but we were successful in reducing the amount owed. |
